The spanish data protection (AEPD) has put in place Electronic a procedure by which the public and private entities obliged to appoint a delegate of data protection (DPD) to communicate this appointment, as set out in the General rules on data protection (RGPD) that it applies the next 25 may.
The DPD is compulsory for organizations that deal with personal data intensive or sensitive data on a large scale, as well as government agencies. The RGPD reflected that those responsible or responsible for treating must publish contact data of DPD and communicate his appointment to the supervisory authority. This communication to the agency by the holders must take place prior to 25 may.
The new procedure for the submission of the delegate of data protection it is a form which can be reached with electronic certificate, in accordance with article 14 of law 39/2015, of Common Administrative Procedure of the public authorities.
This system of electronic reporting - which allows the data of the delegate of data protection (whether an individual as a public or private entity acting as a delegate) as well as the data of all those entities for which this has been designado- is not limited to the public and private entities obliged. Companies that are not bound by the forecasts of the rules of procedure to designate a DPD and who want to introduce this model in their organizations as to support fulfilment can use this form so communicated.
